Explaining Litigation that Challenges the Budget Reconciliation Law's Federal Medicaid Payment Ban for Certain Abortion Providers
In anticipation of a federal appeals court decision in a case challenging a provision of the 2025 Budget Reconciliation Law, which blocks federal Medicaid funding for one year to Planned Parenthood clinics (and other family planning providers), KFF examines the status and arguments in the case, as well as other ongoing litigation challenging the ban.
The provision directly affects more than 2.1 million people who receive health care at these sites, but the impact of the upcoming court decision will be limited to Medicaid payments to providers in the 22 states and D.C. that have sued the administration. In this case, a federal district court judge ruled that the law imposes an unconstitutional obligation on states to implement unclear criteria for the ban's scope. The court delayed implementation of this decision until December 9th, and the U.S. Department of Health and Human Services appealed.
